With respect to security: We have appropriate security measures in place in our physical facilities to protect against the loss, misuse or alteration of information that we have collected from you at our site. Including an 128-bit SSL certificate for payments with VeriSign. Although we make every effort to protect all information entered into our site, we cannot guarantee that this information will not be comprimised. In such events, you hereby agree to hold Property Panorama harmless for unauthorized access and/or use of any and all information entered into the Property Panorama website. If you do not agree to this clause you should not enter any information into the Property Panorama website. By entering information into the Property Panorama website, you signify your agreement to this policy.

1) There is a 30-day unconditional money back guarantee for the initial fee for the first month's subscription. After the initial 30 days of subscription, the account may be closed at anytime without penalty by sending notification of your desire to close subscription at least seven (7) days prior to the next forthcoming billing date. Notifications of cancellation must be sent in the form of e-mail via the contact us page.

2) Subscriber agrees to have the cost of the monthly subscription fees (plus any applicable sales taxes) automatically charged to their credit card or bank account. Unless otherwise specified in writing in an Agreement between Subscriber and Property Panorama, Inc. Subscriber understands that subscription fees will be charged automatically every four (4) weeks. Subscriber understands that this Property Panorama, Inc. service is offered solely on an on-going subscription basis and may be cancelled automatically for non-payment. Should the account be cancelled, the client software will no longer function and the online account and tours will not be accessible. Any tours and account information will be retained for 90 days after the expiration or cancellation of an account. A reactivation fee may apply.

3) This subscription agreement permits one agent to create an unlimited number of tours for their own personal listings. Posting of tours other than the agent’s own tours (i.e. office tours, tours for other agents, etc.) shall be cause for immediate cancellation of users Subscription. Subscriber furthermore agrees that any and all tours posted that are not the agent’s own tours will be charged to the credit card or bank account provided to Property Panorama, Inc. by Subscriber at a rate of $14.95 per tour for each and every such tour created illicitly as aforementioned, throughout the entire time Subscriber has been a Subscriber to the Property Panorama service. MarketLinx users are exempt from this clause.

4) Right to Use: Property Panorama, Inc reserves the right to use a copy of all tours. Any and all virtual tours created using the Property Panorama, Inc. products and/or services may be used in any fashion whatsoever that is deemed desirable by Property Panorama, Inc. at the sole and exclusive discretion of Property Panorama, Inc.

5) Additional Product/Service Purchasing: Subscriber understands that Subscriber may purchase additional products and/or services when logged into the account of Subscriber. Should the Subscriber desire to purchase any product and/or service while logged into account of Subscriber, Subscriber authorizes Property Panorama, Inc. to charge credit card or bank account which was provided to Property Panorama, Inc. by Subscriber for the purpose of payment of subscription payments for any and all such additional product and/or service purchases.

6) Liability Limit: It is agreed that the entire remedy should Property Panorama, Inc. be found to be in breech of this contract shall be limited to the actual price paid for the order above and shall not include or extend to any claim for or right to recover any other damages, including but not limited to loss of profit, or special, incidental or consequential damages or other similar claims. In no event will Property Panorama, Inc.'s liability for any damages to you or any other person ever exceed the actual price paid for the current four (4) week period of subscription. Under no circumstances shall Property Panorama, Inc. be liable to refund any fees and/or charges, which were paid to Property Panorama, Inc. by Subscriber for any additional product and/or service whatsoever.

7) Additional Provisions: By entering into this Agreement, site user also agrees without condition to the Property Panorama, Inc. User Agreement in its entirety. Property Panorama, Inc. reserves the right to update this Agreement at any time with or without notice to Subscriber. Should Subscriber find that this Agreement has been updated and Subscriber does not wish to continue with any and all such updated terms, conditions, and/or provisions Subscribers only option is to cancel subscription. By entering the Billing Information (Credit Card and/or Bank Account Info.) Subscriber agrees to all that is set forth within this Agreement without exception or limitation.

8) Addendums: Property Panorama also offers virtual tours for sale on a pay-per-tour basis. For this type of account, the subscriber pays no monthly recurring fee. Instead the Subscriber shall pay Property Panorama, Inc. the rate specified for each virtual tour as outlined on the Property Panorama Rate Card, and/or the per tour price specified on the website of Property Panorama, Inc. Pay-Per-Tour virtual tours may only be used to create virtual tours for Individuals other than the Subscriber if the creator of such tours is a Certified Reseller licensed by Property Panorama, Inc. All other subscribers may only create these Pay-Per-Tour virtual tours for their own personal Real Estate listings as outlined in section 3 above. Such Pay-Per-Tour purchases are non-refundable. Property Panorama, Inc. reserves the right to update this and any policy and/or policies herein with or without notice to Subscriber. These updates may be made at any time, and as often as is deemed necessary by Property Panorama, Inc. at it’s sole discretion without limitation.
